Muhwezi Trial Flops

The trial of the former Health minister Jim Muhwezi, accused of the alleged embezzlement of 1.6 billion shillings has flopped.

The trial which was expected to begin today flopped under procedural complications.

Earlier, the case against Muhwezi and his co-accused Mike Mukula and Dr Alex Kamugisha was scheduled to be heard by Buganda Road Court chief Magistrate, Margaret Tibulya.

This morning however, court heard that the case would be prosecuted jointly by the Director of Public Prosecutions, (DPP) and the Inspector General of Government (IGG), Faith Mwondha.

The DPP however asked that the case be adjourned to allow him more time to study the case file. He argued that he needs more time to study the fresh charges by the state against Muhwezi and Kamugisha.

Muhwezi faces a new charge of abuse of office. He is accused of approving the requisition for the use of 1.7 billion shillings from the GAVI fund.

Kamugisha on the other hand faces charges of causing financial loss and obtaining money by false pretence.

The State alleges that he received 11.4 million shillings from the GAVI account of Ministry of Health to facilitate the travel for 57 MPs who were involved in immunization mobilization in their respective constituencies.

The State also alleges that Dr Kamugisha failed to ensure that the MPs accounted for the said money thus causing financial loss to the Government of Uganda.

Muhwezi faces five counts including embezzlement, theft, causing financial loss, and abuse of office.

Captain Mukula on the other hand is accused of unlawfully requisitioning and approving use of more than 263 million shillings from the GAVI funds between February 11 and October 28, 2005.

Mukula is jointly charged with Muhwezi for misappropriating another 210 million shillings from Gavi, through advocacy conferences purportedly organized by the First Lady's office in Gulu and Mbale.

Dr Kamugisha had earlier on been charged with abuse of office. He is alleged to have authorized the release of more than 10 million shillings from Gavi to Dr Aida Nankinga of Sheema North Constituency in Bushenyi, purportedly to carry out immunization and sensitization activities in the area.

Ms Kaboyo is accused of fraudulently diverting Shs250 million in government money from the Gavi account to her personal use on November 9, 2005.

The case against all four stems from investigations by the inspector general of government into the alleged gross misuse of the funds given to Uganda.
