The High Court in Tororo has dismissed with costs an application which was filed by the Busia district chairman, Ouma Adea, seeking to object an election petition filed against him.
Adea’s election is being challenged in court by a voter in Busia District, Godfrey Mugeni. Mugeni sued the Busia district chairman for the alleged lack of the required academic papers.
Adea’s counsel told court that the petition was improperly served and that explains the reason why they did not reply to the petition.
The Electoral commission counsel, told court that the petition was incompetent, it did not have 500 signatures of the registered voters for it to succeed.
But justice Rugadya Atwooki said the application for objection was baseless, becuse the petition had all the details with 613, the total number of registered voters except 8 whose signatures were not appended.
Atwooki dismissed the case and fixed 7th July 2011 as the day for final hearing of the case with all its merits.
He directed Adea’s counsel to serve all parties with amended petition attached with certificate of higher education within seven days from today.
