The petition was filed by Yeri Apollo Ofwono, one of the losers in the February 18 elections.
 
Ofwono argued that Sanjay Tanna lacked the required academic papers to be a member of parliament, committed electoral offences by bribing voters and used defamatory language against his opponents.
 
Justice Rugadya Atwooki, while delivering his ruling this morning in a fully parked court room, stated that the petitioner failed to satisfy court yet it was his entire responsibility to prove his case.
 
Atwooki dismissed the petition in favor of Sanjay but directed that since the whole electoral process was characterized by tribal sentiments, both Ofwono and Tanna meet the costs of the suit for the purpose of harmonious co- existence.
 
Sanjay’s supporters immediately lifted the jovial looking MP shoulder high as they walked out of court premises and matched to the tune of a brass band in jubilation to the town center.
 
Ofwono and his supporters, who had spent the whole weekend celebrating in Sun rise bar in anticipation of court victory, were left disappointed. Ofwono’s lawyer, Hassan Kamba was not in court.
 
The heavy security personnel at the court premises under the command of the district police commander, Robert Katuramu, kept a close watch on Ofwono’s supporters following threats to cause chaos incase the ruling was not in favor of the petitioner.
