The Kampala Capital City Authority Executive Director Jennifer Musisi insists she is acting within the law as she executes her duties.
Through the KCCA legal department lawyers led by Charles Ouma, Musisi filed her defence in response to the suit filed by the Lord Mayor Elias Lukwago.
Lukwago has dragged the KCCA executive director to court accusing her of usurping his powers.
Musisi says she was tasked by government as the head of the public service of the Authority to lay a foundation for the operations and administration of the authority. This included compilation and submissions of the budget and salary structure for staff, making proposals and administration.
She argues that the ministry responsible for Kampala City in consultation with the Ministry of Public service and the Ministry of Finance recommended the remuneration of the political leaders in the Authority.
She also denies ever convening an authority meeting which role is the preserve of the Lord Mayor, according to the Fourth schedule to the KCCA Act 2010.
That regarding the disposal of KCCA dispensary on Plot 71 Nkurumah road, the investigations are still ongoing for the purposes of criminal prosecution and the matter is before Court.
Musisi adds that she is not bent on frustrating the Authority’s strategies for improvement of standards in the taxi industry. She concludes that she has executed her duties in total compliance with the KCCA Act and in particular section 19 of the Act which stipulates her functions.
On the 20th of September, Lukwago sought a declaration restraining Musisi from interfering with the activities that should have been executed by him.
According to the petition, Lukwago accuses Musisi of making it extremely difficult for him to execute his duties as well as developing strategies and programmes for the city.
He cites Musisi's proposal of KCCA top managers' salaries which was forwarded to the ministry of finance without consulting him.
Lukwago now wants an order retraining Musisi from acting beyond her powers. He also demands that Musisi produces a report concerning the fraudulent sale of the KCCA dispensary at plot 71 Nkrumah Road, since she is the one who frustrated efforts to carry out investigation into the same.
High Court Judge Eldard Mwangusya has set Friday this week for ruling on the matter.
