The High Court in Kampala has summoned President Museveni in his capacity as National Resistance Movement chairman and Amama Mbabazi, the party Secretary General to appear and explain why NRM should not be wound up and liquidated.
The summons arises from a case in which an NRM member, Maguru Ruhinda Daudi, sued the party in 2010 challenging the election of President Museveni unopposed for party chairmanship.
In his suit, Maguru said it was wrong for President Museveni to claim to have been elected unopposed when there were other candidates who sought the same post, but had their candidature unlawfully nullified.
The case that was brought before former Principal Judge James Ogoola later ended in a consent judgment where the party leadership committed to put in place an independent Electoral Commission to hold fresh elections for the party chair within 10 months after last year’s February General elections.
The party also agreed to hold another delegates’ conference to settle the unresolved disputes by August 2011 and also pay Maguru 70 million shillings as costs of a suit he had filed against them.
Maguru has now gone back to court saying the party officials have not taken any step to fulfill the terms of the agreement yet the party has neither known available assets nor an active bank account which he would attach.
Deputy Registrar Isaac Muwata fixed the case for February 29th.
NRM publicist Ofwono Opondo, when contacted, declined to comment saying legal matters in the party are handled by the local government minister, Adolf Mwesige. The minister could not be reached as he was reportedly in a meeting on Wednesday evening.
