Kampala High Court Judge Eldad Mwanguhya has set June 29 to rule on the case filed by Kampala Lord Mayor Erias Lukwago against the city executive director Jenifer Musisi.
The setting of the date followed submissions made by lawyers from both sides the dismissal of the application at this preliminary stage.
The case involves Lukwago, who sued Musisi last year seeking court declarations among others restraining the latter from passing off as the head of the Kampala Capital City Authority (KCCA) and also to his office as ceremonial.
Earlier this week, Andrew Kasirye, the lawyer representing Musisi, asked the court to dismiss Lukwago’s case against his client on grounds that section 81 of the KCCA Act 2010 protects her from any form of court action arising from discharge of her duties in good faith.
On Friday, however, in reply to this immunity, Lukwago’s lawyer Medard Sseggona asked the court to dismiss the preliminary objection raised by Musisi’s legal team and have the matter heard in its entirety.
Sseggona argued that Musisi acted in bad faith and outside her powers, which action he said, should be investigated by court by way of judicial review.
Should court agree with the arguments of Musisi's legal team, the over one year legal battle between the two KCCA leaders will end and on the contrary, it will be heard to its entirety.
Lukwago was present in court with a few of his supporters while Musisi was absent.
