Justice Angelina Flavia Senoga has nullified the elections of Agnes Nabirye as Jinja district Woman Member of parliament. She made the ruling this morning, while delivering judgment on an election petition filed by Maureen Kyalya Walube, the former FDC candidate for the Jinja district woman MP seat.
Walube contested the polls and lost to Nabirye, who polled 45,406 against her 36,733 votes. She rejected the polls results, and petitioned court citing ballot stuffing. Through her lawyer, Mohammad Mbabazi, Walube asked court to order for a fresh vote recount from all the 212 polling stations in the district, which was granted.
However, only 211 out the 212 ballot boxes were delivered for the vote recount forcing Justice Angelina Flavia Senoga to suspend the exercise citing irregularities. Justice Angelina Flavia Senoga adjourned the case and ordered both parties to wait for the final court ruling, which she delivered in this morning. In her ruling, the judge concurred with the applicant that there were cases of electoral malpractices such as ballot stuffing and therefore nullified the election of Nabirye.
She ordered electoral commission to pay the cost of the suite and organize fresh elections. Maureen Kyalya Walube, the petitioner has welcomed the court ruling saying that it proves her claims of election irregularities. Agnes Nabirye, the incumbent has declined to comment on the court ruling saying that she is still awaiting legal advice from her lawyers.
