Kampala Capital City Authority has resolved to seek Justice George Wilson Kanyeihamba’s legal interpretation of the KCCA Act 2010.

Jennifer Ssemakula Musisi, the KCCA executive director and Lord Mayor Erias Lukwago have been engaged in a power struggle for over a year over who is the head of the metropolitan authority.

Earlier this month, High Court Judge Eldad Mwanguhya dismissed a case filed by Lukwago against Musisi saying the issues that Lukwago asked the Court to resolve are aspects of interpretation of the Act. The issues include determining the head of KCCA, clarifying the position of the Lord Mayor and determining who plans and fixes salaries for KCCA workers among others.

On Monday, councilors led by Bruhan Byaruhanga resolved to engage the opinions of legal experts outside the council in interpretation of the law.

The interpretation shall have to be made in a workshop where legal experts including Justice George Kanyeihamba and Adolf Mwesige, the minister for local government among others would interpret the KCCA.

Erias Lukwago had convened a meeting to resolve the standoff on the powers of the lord mayor, the executive director, councilors and the urban authorities.

Shortly after the meeting, Musisi told Uganda Radio Network that the decision to have legal interpretation of the KCCA Act is paramount as some of the councilors are still stuck with the local government act which is no longer applicable in Kampala.

Musisi insists the poor interpretation of the law has resulted into the delay in service delivery in the city.
