Aciro Lucy Otim, the Member of Parliament for Aruu North constituency in Pader district will not appeal against a ruling of the High Court which nullified her election early today.

Her lawyer Samuel Odonga Otto said after a meeting this afternoon that the ruling by Justice David Matovu, which called for fresh Parliamentary elections in Aruu North, Pader district, was acceptable and that appealing would be time consuming.

The court decision is based on an appeal by the National Resistance Movement-NRM party candidate James Nabinson Kidega challenging the outcome of the February 18 parliamentary election.

Kidega lost the race to independent candidate Lucy Achiro Otim with a difference of two votes. She polled 8,599 votes against Kidega's 8,597, according to results released by Pader district returning officer Joseph Amone. But he disputed the result on the basis that many of his valid votes were tallied as invalid.

Although he had initially sought for a vote recount, the exercise was suspended after ballot boxes were destroyed by a mob that attacked police on February 29. On the basis of this, Justice Matovu ruled that the destruction of voting materials denied Kidega justice through a recount.

In concession, Odonga Otto said they await the Electoral Commission to start preparations for a by-election. He added that Aciro will this time contest as a candidate for the opposition Forum for Democratic Change-FDC party.
