Balunywa Asks Court to Dismiss Fraud Charges Against Him

Prof. Juma Waswa Balunywa, the Principal of Makerere University Business School-MUBS has asked Nakawa Court to dismiss the case of alleged fraud privately brought against him for lack of sufficient evidence. Balunywa was dragged to court by David Bwambale and Simon Tendo Kabenge, both city lawyers for alleged forgery and uttering false documents.
 
The duo claim that in September 1994 while at MUBS, Prof. Balunywa knowingly and fraudulently with the intention to defraud government uttered false academic documents to Makerere University including the East African Certificate of Education, the East African Advanced certificate and Curriculum Vitae so as to procure promotion to the rank of Associate Professor in the employment of the university and receive higher salaries and other emoluments.
 
The duo also claim that Prof. Balunywa forged academic certificates in names of Juma J. Balunywa of Kamuli College, Namasagali and used them to get employment first as a lecturer of Makerere University in 1983 and subsequently as the principal and accounting officer of the institution. They also claim that being a public officer employed as principal and accounting officer at MUBS at Nakawa on various dates, Balunywa failed to execute duties of an accounting officer in connection with controlling expenditure of MUBS funds in the sums of USD $13,000.
 
But through his lawyer Fred Muwema, Prof Balunywa told court on Wednesday that the charges against him are improper because they are still subject to police investigations. Muwema also told court that the complainants had presented paper cuttings from the investigations by the IGG as evidence, which he said is malicious. Flavia Nassuna, the Nakawa chief magistrate adjourned the case to June 25 on request by Bwambale for time to respond to the argument by the defendant.
