Justice Michael Elubu has dismissed a petition challenging the election of Aisha Ssekindi, the Kalungu Woman Member of Parliament for alleged voter bribery and lack of academic qualifications.

He made the judgment this morning in Masaka High court in response to an application filed by Ssekindi's rival, Aisha Waligo. In his judgment, Justice Michael Elubu, said the petitioner failed to produce substantial evidence pinning her rival for lack of the requisite academic qualifications and voter bribery.

On the mismatch of Aisha Ssekindi's name, Elubu said Waligo failed to present the head-teacher of Kyato primary School in Kalungu district, where the respondent claimed to have sat her Primary Leaving Examinations. During the hearing, Waligo told court through her lawyer, David Tebusweke that Ssekindi didn't sit her PLE at Kyato primary as she claims.

She claims the PLE result slip used by the respondent bears the names of her brother, Isa Ssekindi. However, Justice Elubu said the petitioner had time to present the said Isa Ssekindi in court in vain. Despite the fact that the National Council for Higher Education presented a letter from Kyambogo University disowning Ssekindi, Elubu says court is satisfied with the statutory declaration she presented at her nomination.

He therefore dismissed the petition cost to the petitioner. He directed the petitioner to pay the respondents all the money she has spent on the suit.
