Lawyers Ask Court to Dismiss BUKITAREPA Land Suit

Lawyers representing land boards from seven districts in Bunyoro region want High court to dismiss a suit filed by Bunyoro Kitara Reparations Agency-BUKITAREPA for issuing titles on land they don't own, saying it is baseless.

In 2016, BUKITAREPA petitioned Masindi High Court to cancel all titles issued by land boards from seven Bunyoro districts. They include Masindi, Hoima, Kibaale, Kakumiro, kagadi, Kiryandongo and Bulisa districts. 

In May 2017, BUKITAREPA secured orders from the then Masindi High Court Registrar, Julia Acio stopping the land boards from issuing any land titles until the matter before court is resolved.
 
High court lifted the order this year. On Wednesday, the matter came up for hearing before Masindi Resident Judge, Albert Rugadya Atwooki. Simon Kasangaki, the lawyer of Masindi and Kiryandongo District Land boards asked court to dismiss the suit with costs, saying BUKITAREPA didn't explain the type of titles they want cancelled and who owns them.

 
He also told court that the petitioners don't point out the particulars of the fraud on the part of the land boards and don't show cause of their action since they didn't tell court about the contested land. Kasangaki spoke to URN about his submission outside the court room.

Ronald Mugisa, the lawyer of Hoima district land board also asked court to dismiss the suit, saying BUKITAREAPA failed to tell court the location, size and threats accruing from the conduct of the district land boards.

BUKITAREAPA's lawyer, Chrispus Ayena Odongo, said there is no need for court to dismiss the case, saying the suit affects the land titles issued by the land boards. He explained that land boards have no mandate to issue land titles on customary land.
