Lira High Court Dismisses Election Petition Against MP Ebil

Lira High Court Judge, Stephen Musota, has dismissed with costs an election petition filed against Kole County MP, Fred Ebil Ebil.

Musota said the petition was not filed in accordance with the law and was therefore rendered invalid. He argued that the petitioner at the time of presentation did not pay the required fee of shillings one hundred and fifty thousand, which is a requirement.

According to an earlier submission by Prof. Otim’s lawyer, Chris Bakiza, the petitioner paid only one hundred thousand shillings, contrary to the law. Bakiza argued that they had the full payment, but that the high court registrar told them only to pay one hundred thousand shillings, a claim which the judge quashed.

Ebil, a member of Uganda People’s Congress, defeated NRM’s Prof.George William Otim Nape in the February 18th 2011 elections. But Prof Otim challenged Ebil’s victory citing electoral malpractices.

Mike Abwango, the defense lawyer said it was not optional for the petitioner to comply with the law saying that their intention was to down play the rules of procedures, something which is unacceptable.

Ebil, who had hired a three-man defense team including Odongo Luis, Onono Quirinos and Mike Abwngo, said the dismissal of the petition was done independently.

He said a claim by his rival of gross abuse of electoral laws and voter bribery were totally concocted propaganda, which he said is against the interests of the local people of Kole who voted for him.

Prof.Otim declined to comment on the ruling, saying they are still digesting the court’s action.

This is the second election petition to be dismissed with costs by Justice Stephen Musota.

Last month an election petition against Oyam South MP, Betty Amongi filed by Sam Otoo Ochola, was dismissed by the same court.
