Masaka Diocese Lose Land Case, Ordered To Pay UGX 20m Costs

Masaka Grade One Magistrate Esther Nambayo has ordered Masaka Diocese to pay 20 million shillings costs and to immediately vacate 9.3 acres piece of land belonging to an elderly woman.
 
The order comes after the diocese lost a land case to the 89 year old woman Irene Nakitto, a resident of Matanga Village, Butende Sub County in Masaka district.
 
Nakitto dragged the Masaka Diocese to court challenging the manner in which the church got ownership of the 9.3 acres piece of land on plot number 270 at Matanga Village given to her by her late father Siperito Kasule.
 
Court has also ordered for cancellation of all letters of administration bearing Masaka Diocese names to allow the registration of Irene Nakitto as the rightful owner of the land.
 
Court also discovered that the district land office did not register Nakitto as the owner of the land but instead registered Masaka diocese. Nakitto discovered this in the 1980s as she tried to fight the diocese encroachment on her land in courts of law.
 
Magistrate Nambayo added that court has granted Nakitto 20 million shillings for the damages caused to her since 1995 when she begun pursuing the matter in court.
 
 
A jubilant Nakitto and her lawyer Frank Ssewagudde welcomed the court. She said sher was not sure she would win the case as it had dragged on for 18 years with no end seemingly in sight. 
 
Masaka Diocese Lawyer John Baptist Kawanga of John Kawanga and Company Advocates declined to comment on the matter.
