Mutabazi Summoned over Continued ‘illegal' Stay in Office

The High Court in Kampala has summoned the Executive Director of the Uganda Communications Commission (UCC) Mr Godfrey Mutabazi to respond to allegations that he is, among others, illegally in office.
 
The Court has given Mutabazi 15 days to respond to allegations or else judgment will be passed against him in his absentia. Also sued is the Uganda Communications Commission (UCC).
 
The summons against Mr Mutabazi and UCC follow a suit filed against him by two concerned citizens;  Brian Ogago Abangi and  Norah Kagwa.
 
The duo petitioners among others accuse Mutabazi of occupying his office of executive director illegally on grounds that he assumed the same in 2011 without a substantive board which is a mandate.
 
The concerned citizens now want court to permanently stop Mutabazi from occupying his office and also refund all the salary and benefits that he has earned since 2011 to date, saying he earned it illegally since he assumed office unlawfully.
 
The petitioners claim that Mutabazi has gone further to usurp the powers of the board and made decisions like the imminent switching  off users of the unregistered SIM-cards among others, work which they say is a reserve for the board as per S.9 (1) of the Uganda Communications Act.
 
Further, the petitioners state that UCC has operated without a board and yet its activities are supposed to be monitored and checked by the same board and that Mr Mutabazi and UCC have gone ahead to carry out the activities without supervision, a move the petitioners say bears illegalities and is irregular in light of the law.
 
This is the second time that Mr Mutabazi is sued over similar allegations.
