UNRA Compensation Divides Masindi District Leaders

A row has erupted between Masindi district Local government and Budongo Sub County local government over compensation money from Uganda National Roads Authority (UNRA).

The money totaling 41.3 million Shillings was given to the Sub County in compensation for developments that will be affected by the construction of Masindi-Butiaba road. The affected developments include a sugar plantation and trees occupying over two acres of land, and a market in Karongo Village.

However, Masindi district local government wants to take 35 percent of the money, which amounts to 14.6 million shillings. But the Sub County has rejected the request on grounds that none of the properties in question will affect projects outside the Sub County.

Budongo Sub County chairperson Kenneth Kiiza Nyendwoha says that they are not ready to remit money which has not come as revenue He added that the Sub County council has resolved that the money should be used to replace damaged and displaced properties.

The District Chief Financial Officer David Baguma has since written to the district Chief Administrative Officer informing him of the sub county's refusal to remit the money. Baguma quotes section 85(2) of the local government Act that he says puts the lower local governments in charge of collecting local revenue and later remit 35 percent to the higher local governments.

He argued that the district is mandated by regulation 39(1) of the local government financial and accounting regulation 2007 to use appropriate measures to recover the money from lower local governments. 

But Nyendwoha says that the Sub County has also sought for the intervention of the district chairperson.

The district chairperson Cosmas Byaruhanga confirmed receiving the complaint and noted that the money is not revenue to the district.  He, however, says the district executive was trying to resolve the matter.
