There was panic at Hoima Magistrates Court on Friday morning after one of the witnesses died shortly after a court session.

Alozio Sabiiti, 70, died within the court premises at about 10am. The deceased had come to testify in a land case between two local residents, Moses Byaruhanga and Phenekansi Ruhirabake of Busiisi Division in Hoima Municipality. He was testifying in favor of Byaruhanga.

Speaking to journalists after the incident, Byaruhanga explained that Sabiiti got out of the courtroom moments after the presiding Magistrate, Richard Ndangwa, had adjourned the case hearing to October 28. Byaruhanga explains that moments later Sabiiti collapsed just outside the courtroom and died a few minutes later.

Lydia Tumushabe, the Albert region police spokesperson, told URN on phone that police was waiting for a postmortem report to ascertain the exact cause of death. Quoting some relatives however, Tumushabe said the deceased was suffering from hernia.

But Byaruhanga claims his witness had not complained of any illness of recent despite the fact that he was operated on for hernia some years back.

At the time URN reporter arrived at the court, Ruhirabake's group had fled on realizing the sudden death. Richard Ndangwa, Hoima Grade One Magistrate declined to comment on the matter.

Kadir Kirungi, the LC3 Chairman for Busiisi Division, who arrived at court shortly, blamed courts for always taking long to deliver justice in such land cases.

Moses Byaruhanga dragged Phenekansi Ruhirabake to court in 2009 over a 35-acre piece of land in Kitemba village.
